dekstech Credits Terms of Service

By accessing or using the services provided by dekstech, you (the "Customer") agree to be bound by the following Terms of Service. Please read these terms carefully before proceeding.

1. Project Requirements

In order to ensure smooth and uninterrupted progression of projects, the Customer agrees to provide all necessary information, resources, and access promptly. Failure to provide these required elements may result in delays and increased utilization of credits for scope definition.

2. Design Revisions

The Customer is entitled to unlimited design revisions, provided there is a positive credit balance, and it is understood that each revision will utilize more credits.

3. How dekstech Credits Work

dekstech credits operate as a prepaid system. Each month, the Customer is allocated a set number of credits to cover services including development, consulting, store management, and other Shopify-related needs. Unused credits will roll over into the following month, with no expiration. Should the Customer require additional credits, they may purchase additional credits at any time. dekstech credits are not always equivalent to actual hours but are based on the complexity and type of work performed, ensuring tasks are completed efficiently and with appropriate expertise.

Key Features of the Credit System:

  • Flexible Credit-Based System: Credits are allocated monthly and may be used for a wide range of services, including but not limited to development, consulting, and store maintenance.
  • Efficient Resource Allocation: Credits are redeemed as services are rendered, ensuring that each credit expended provides maximum value for the Customer's business.
  • No Expiration, Full Flexibility: Unused credits roll over into the next cycle and do not expire. The Customer is permitted to pause or cancel their subscription at any time without incurring penalties.
  • Seamless Scaling: Should the Customer exhaust their credit balance, they may choose to:
    • Wait for the next cycle to renew the credits, or
    • Purchase additional credits to maintain work momentum on high-priority tasks.
  • Transparent Value: The system ensures that the Customer only pays for services actually utilized, with no hidden fees or unused hours. Credits are allocated according to the complexity of each task, ensuring that the Customer is charged appropriately for the service provided. Development hours that are utilized will also include Quality Assurance and testing, charged at a higher development rate to ensure the Customer receives the best result.

Project management is an essential aspect of every project and is provided at a rate of 1.33 credits per hour, which is equivalent to $100 per hour. This rate covers all planning and coordination necessary for the successful completion of the project.
The Customer acknowledges that all rates are subject to change at the sole discretion of dekstech. Any adjustments to the rates will be communicated to the Customer at least thirty (30) days prior to the next subscription cycle.

4. Transparency and Reporting

dekstech employs detailed internal tracking for all hours spent on projects to ensure full transparency. This tracking system is diligently maintained, and the Customer may request a report of all hours worked, credits utilized, and remaining credits at any time during the course of the project.
The goal of dekstech is to provide regular updates to the Customer on the type of work performed, credits utilized, and the remaining balance of credits to keep the Customer informed and involved in the progress of the project.

5. Work Classification and Scope

dekstech retains the exclusive right to classify the type of work to be performed, including but not limited to store maintenance and the levels of development (Level 1, Level 2, Level 3, or Level 4). The classification of work will be determined solely by dekstech and will not be subject to dispute by the Customer. This classification will be based on the complexity of the task and will ensure the appropriate expertise is applied.

6. Payment and Dispute Resolution

By accepting this proposal, the Customer agrees to pay the full amount specified in the agreement. No refunds will be issued for services already rendered.
The Customer is responsible for ensuring the scope of work is clearly defined prior to commencement. Any modifications to the scope after the project has begun will result in additional credits being utilized to cover the new requirements. In the event of unforeseen circumstances leading to significant deviations from the agreed-upon scope, dekstech reserves the right to adjust the original estimate, and additional credits may be required to complete the project.
The Customer agrees not to initiate any financial disputes with their financial institution regarding invoices issued by dekstech. Should any concerns arise, dekstech will work with the Customer to resolve the issue promptly and through the designated communication channels. All payment disputes must be handled directly with dekstech.

7. Definition of a Credit

A dekstech credit represents a unit of value used to track the consumption of services offered by dekstech. Credits are not strictly equivalent to hours but are based on the complexity and type of work performed. The allocation of credits reflects the expertise and time required for specific services, with more complex tasks requiring more credits.
Credits are used for a variety of services, including but not limited to development, consulting, store management, and other Shopify-related services. The number of credits assigned to a task may vary based on its level of complexity. The Customer acknowledges that credits will be allocated according to the specific nature and complexity of each service provided.
